Manhattan DA’s Office tells mother to surrender baby – but she’s not surrendering

Manhattan District Attorney Cyrus Vance Jr. said this week prosecutors aren’t dropping the case. Instead, he’s asking the woman not to surrender the baby that was allegedly stabbed multiple times, and that was fatally wounded in a brutal attack that was recorded on surveillance video outside her Wards Island residence.

The DA’s Office said it’s going to keep the case open and would not recommend that the mother hand over the child to New York City Child Protective Services until the investigation is complete.

The district attorney’s office confirmed that the mother has been charged with murder. She faces up to 25 years in prison if convicted.

The video shows her holding her bleeding toddler under her arm while the other man approaches her and appears to stab the baby. Both are seen in the footage, which was captured by surveillance cameras.

The child is reportedly 3 months old.

“Baby should be alive,” the woman screams. “Baby is already dead.”

The baby is seen in the video bleeding to death on the ground, with a wound on his back.

The woman’s attorney, Lisa Gedicks, told a judge Tuesday, that the woman “does not plan to surrender the baby” to CPS.

“I’m very surprised by what’s going on,” Gedicks told the judge. “The baby, who’s not going to die has to be with mommy and daddy.”

Cyrus Vance Jr., the Manhattan DA’s top man for the past three years, has been working without a budget for the past year, which has meant little progress on the murder case. He has also been hampered by a dearth of resources, and by a shortage of investigators.

With no funding or resources, the DA’s office has been forced to rely on private investigators, a handful of prosecutors and other detectives, to do the work it takes to keep the defendant and the case alive.
